This Privacy Policy describes what information Stacks collects and how it uses and shares information as part of its Services. This Privacy Policy encompasses all Stacks Services including, but not limited to, Stacks web platform, mobile or tablet application. Note that any capitalized terms not defined in this Privacy Policy have the meanings set forth in our Terms of Service. 1. Collection of Information
When you use Stacks, we collect the following information and use it only as described below. Stacks and the Licensor, EBSCO Information Services, will share information collected when creating and setting up user accounts. Specifically, the username and email of each internal user is collected. If batch loaded - it is the responsibility of the customer/administrator to have obtained the right to load user data on behalf of user.
Stacks Platform
Based upon the purpose and relationship with the individual user this information has the Lawful Basis for being processed based on Legitimate Interest.

Stacks Internal Users - Stacks has full control of data and is the owner of the data.

Integrated User Details - Stacks integrates data in real time via trusted services provided by other vendors. All security specified protocols are followed. Stacks does not retain this data beyond the session and is not the owner and/or controller of the data.
Stacks Service Providers
Voluntary consent from Stacks service providers includes:
- Aha! for the collection of new feature requests & product enhancements.
- MailChimp for Stacks Marketing & Product Communications.
- Microsoft 365 for product demonstrations, webinars, online training, and meetings.
- Monday.com for project & service management
- ZenDesk for Customer engagement, support and product documentation.
Only opt-in provision of business-type data is typically published online. Each of these services house the data voluntarily entered. Information collected here may be used for provision of service/sales information sharing. This information may be shared with EBSCO or other official partners as is in the best interest of the voluntary customer/prospective customer.
1.1. Individual Users. Authorized Users of Stacks products are not typically known to the company as Individuals. Stacks does not require the use of personal information in order for users to access our Services. Individual Users may choose an authentication method that could link to personal user information; however this is not a requirement for using Stacks products. Personal information may include, but not limited to name and email. We use this information in the ways you would expect, such as to set up your Account or contact you. Under no circumstances will Stacks sell this information and we will only share it with affiliates and third parties (e.g. contractors) involved in carrying out services if they safeguard this information, consistent with the Stacks Privacy Policy. Individual Users may choose to disallow the use of their personal information, as described in the Policy by completing the Objection Form. Note that Stacks does not have access to source personal information from Integrated services and therefore, can only remove your personal data from our systems. Active integrations may be utilized again if your information exists in the integrated system database.
1.2. Customer. The information that Stacks has about Stacks “Customers” (as opposed to Individual Users, outlined above) is exclusively information that relates to purchasing contacts, technical contacts and facilitators of access to the Stacks system. Some of this Customer information might be construed as personalized information and is also covered by Stacks Privacy Policy as well as the Stacks Mobile Store Submission Previews & Authorization.
1.3. Third Party Account Information. If you use Third Party Services, such as social media, you may provide us with your Third Party Services account information, such as your username (note that we don’t store any passwords you use to access Third Party Services). We transmit, and may store, such account information, only as needed to provide the Services, and only in accordance with the terms and policies of the Third Party Services.
1.4. Usage Information. Information can also be gathered from the use of Services. This information would include number of sessions, number of searches, number of articles browsed and usage patterns. Stacks will not sell or share information with third parties relating to usage patterns that could be used to identify or track an individual.
1.5 Cookies and Other Technology. Stacks uses “cookies” for the security functionality on its website. Google Analytics is also used to help analyze how users use the site. Google Analytics also uses cookies to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the website (including your IP address) is transmitted to Google. This information is then used to evaluate visitors' use of the website and to compile statistical reports on website activity for Stacks, which gives the opportunity to identify problems and improve service.
Stacks will not use the statistical analytics tool to track or to collect any personally identifiable information of visitors to our site. Refer to the Google Analytics privacy policy at www.google.com/intl/en/privacy/privacy-policy.html. Stacks will not link, or seek to link, an IP address with the identity of a computer user. Stacks will not associate any data gathered from this site with any personally identifiable information from any source, unless you explicitly submit that information using a form on our website.
2. Sharing
When you use the Services, we may share your information only in the ways outlined below:
2.1. Third Parties You Authorize. You can give third parties access to your and your End Users’ information on the Services. For example, you may wish to integrate Your Sites with a third party newsletter service that requires access to the email addresses you collect from your End Users, in order for that newsletter service to send emails on your behalf and at your direction. Just remember that such third party’s use of this information will be governed by the terms and privacy policies of the third party.
2.2. Following the Law. Stacks reserves the right to disclose personal identifying information if the company is required to do so by law, or in the good faith belief that disclosure of the information is reasonably necessary to comply with legal process, to respond to claims, or to protect or advance the rights, property, safety, or well-being of the company, Stacks employees, customers or the public.
2.3. Business Transfers. If Stacks is involved in a reorganization, merger, acquisition or sale of our assets, your information may be transferred as part of that deal.
3. Protection
Stacks takes measures to secure all information, including encrypted data transfer, limited and password protected access to this information within Stacks, and security measures at Stacks physical facilities.
4. Communications
When you send emails or other communications to Stacks, such as customer support inquiries or information requests, we maintain those communications and their contents so that we can resolve your inquiries or otherwise assist you. We may periodically email you service-related updates, announcements, marketing or promotional communications. You can opt out of receiving subsequent marketing or promotional communications by clicking the link marked unsubscribe (or a similar phrasing) that’s included in those communications or replying to those communications and indicating that you would no longer like to receive communications.
5. Retention
We will retain your personal information for as long as we need it to provide you with Services. You can ask for your personal information to be deleted at any time by contacting EBSCO support. Please note that there may be latency in deleting your personal information from our servers and backup storage, and we may retain your personal information in order to comply with the law, protect our rights, resolve disputes or enforce our agreements.
6. Location
Information that you submit through the Services may be transferred to countries other than where you live (for example, to our servers in the US). We also may store information locally on the devices you use to access the Services. We also may transfer information to third parties outside Canada for processing or to support the Services, and we require them to provide at least the same level of protection for your information as described in this Privacy Policy. Stacks leverages secure cloud services around the world, sites are hosted dependant on customer locale. All US customers are hosted exclusively in the US. We can also meet data sovereignty requirements in many countries including Germany and Canada.
7. End User Information
7.1 Collection and Use of End User Information. You may use the Services to create or publish Your Site(s) for use by End Users. We may collect, use or delete the same types of information described in Section 1, above, from your End Users, on your behalf and at your direction, and we treat such information in accordance with this Privacy Policy. We do this in order to enable you to use the Services, and to provide, improve and protect the Services. For example, you may ask your End Users to provide name and email address so that you can provide access to Your Site(s).
7.2 Your Relationship with End Users. You can collect, use or delete your End Users’ information at any time. However, you are solely responsible for complying with any laws and regulations that apply to your End Users’ information, including without limitation the posting of your own privacy policy. We are not liable for your relationship with your End Users, and we will not provide you with any legal advice regarding such matters.
7.3 A Message to End Users. Stacks has no direct relationship with you. If you’d like to make any requests regarding your personal information, please contact the owner of the website you’ve visited or used, as they control your data. They may then submit any such information requests to us, and we’ll respond to them. We retain your information in accordance with this Privacy Policy.
8. Modifications
This Privacy Policy may be modified. We will post the most current version on our site. If a modification of significant change is made, we will notify you in accordance with the procedures set forth in our Terms.
